Aluminized Mini Mesh Warranty
COVERAGE
ChainLinkMiniMesh.com warrants its Aluminized Chain Link Fence
Fabric (“Fabric”) is free from
defects in materials and workmanship and, under normal and proper
usage, free from corrosion rot breakage due to
coating failure for a period of twenty-five (25) years after the
date of purchase by the original purchaser.
EXCLUSIONS
This limited warranty is extended only to the original purchaser
and is non-transferable and nonassignable
to any other purchaser or subsequent owner. This limited warranty
does not apply in harsh industrial areas
or marine, coastal, or salty environments. This limited warranty
only applies to defects from normal use. This limited
warranty does not cover defects from changes, damage or corrosion
arising from or in connection with abnormal,
improper or faulty use, installation, design, accident, alteration
of any kind (including affixing any other materials to the
product), neglect, abuse, abrasion, air pollutants, or damage
caused by landscaping equipment or animal activity, plant growth,
abrasive chemicals, exposure to water or soil, fire, flood, or
other act of God. Defects in material or workmanship will be those
recognized under generally accepted standards of the fencing
industry in West Memphis, Arkansas for Fabric of similar style and
value.
CONDITIONS
To make a claim against this limited warranty, send a brief
written description of the situation, including the current
location of the Fabric, the name and address of the dealer from
whom you purchased the Fabric, and proof of the date of purchase
to the address at the bottom of this page. Should
ChainLinkMiniMesh.com, in its sole discretion, determine Fabric to
be defective under the terms and conditions of this limited
warranty, the original purchaser will receive a credit toward the
purchase of replacement Fabric. The amount of the credit will be
pro-rated based upon the unexpired portion of this twenty-five
(25) year limited warranty from the date of purchase. The amount
of the pro-rated credit will apply only to the factory price of
the Fabric at the time the claim covered under this limited
warranty was made. Cost of shipping, transportation, labor,
removal/installation, taxes, inspection, repair or replacement or
any other costs are excluded, and ChainLinkMiniMesh.com will not
be obligated to provide any such services.
THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER
ORAL, WRITTEN, EXPRESS
OR IMPLIED. CHAINLINKMINIMESH.COM MAKES NO OTHER EXPRESS
WARRANTIES AND NEITHER
ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER
LIABILITY IN
CONNECTION WITH THE FABRIC. TO THE MAXIMUM EXTENT ALLOWED BY LAW,
ALL IMPLIED
WARRANTIES ARISING FROM CUSTOM, USAGE, COURSE OF TRADE, STATUTORY
OR CASE LAW,
COMMON LAW, OR OTHERWISE, AND FURTHER INCLUDING WITHOUT
LIMITATION, THE IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR
PURPOSE, ARE EXPRESSLY
LIMITED TO THE TERM OF THIS TWENTY-FIVE (25) YEAR LIMITED
WARRANTY. IN NO EVENT SHALL
CHAINLINKMINIMESH.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL OR CONSEQUENTIAL
DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PURCHASE OR USE
OF THE FABRIC OR FOR
ANY BREACH OF WARRANTY, NEGLIGENCE, OR STRICT LIABILITY.
Some states do not allow limitations on how long an implied warranty lasts, and some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. THIS WARRANTY IS ONLY APPLICABLE TO FABRIC INSTALLED IN THE UNITED STATES.
